These Terms of Use (“Terms”) govern your access to and use of a1foodsafety.com (the “Site”), operated by Netiza LLC d/b/a A1 Food Safety (“we,” “us,” or “our”). By using the Site, you agree to these Terms.
If you do not agree to these Terms, please do not use the Site.
These Terms work together with our Terms of Sale and Privacy Policy.
1. Important Notice — Authorized Reseller and Trademark Use
A1 Food Safety is an authorized seller of ServSafe® products under written trademark permission granted by the National Restaurant Association Educational Foundation. We are not the owner, developer, or manufacturer of ServSafe® products.
ServSafe® and ServSuccess® are registered trademarks of the National Restaurant Association Educational Foundation. All ServSafe® course content, exam content, certification programs, and related materials are the intellectual property of the National Restaurant Association Educational Foundation and its affiliates.
All ServSafe® products are sold AS-IS. For warranty claims, course content questions, exam access, certification records, technical support, or any other product-related issue, contact ServSafe® directly:

2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site, create an account, or place an order. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
By using the Site, you represent that you meet these requirements and that all information you provide is accurate and current.
3. Permitted Use
You may use the Site only for lawful personal or business purposes consistent with these Terms. You agree not to:

- Maintaining the security and confidentiality of your password
- All activity that occurs under your account
- Promptly notifying us of any unauthorized use of your account
We may suspend or terminate your account at any time if we believe you have violated these Terms or for any other reason at our discretion.
5. Intellectual Property
5.1 Our Content
The Site and its original content — including the a1foodsafety.com name and logo, page layouts, design, original text, blog posts, images, and software — are owned by Netiza LLC d/b/a A1 Food Safety and are protected by copyright, trademark, and other intellectual property laws.
You may view, download, and print pages from the Site for your personal, non-commercial use only. Any other use, including copying, modifying, distributing, transmitting, displaying, or selling our content, requires our prior written permission.
5.2 ServSafe® and Third-Party Trademarks
ServSafe®, ServSuccess®, and related logos, course materials, exam content, certification programs, and product designs are trademarks and copyrighted property of the National Restaurant Association Educational Foundation and its affiliates.
We use the ServSafe® name and trademark under written permission from the National Restaurant Association Educational Foundation. All goodwill arising from our use of these trademarks inures to the benefit of the National Restaurant Association Educational Foundation. We claim no ownership of the ServSafe® brand or curriculum.
Other trademarks, logos, and product names appearing on the Site are the property of their respective owners.
5.3 Feedback
If you send us suggestions, ideas, or feedback about the Site or our products, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and distribute that feedback for any purpose, without compensation to you.
6. Course and Exam Content
ServSafe® courses, study materials, exams, and certifications accessed through products purchased on our Site are owned by ServSafe® and governed by ServSafe®’s own terms of use, license terms, and policies.
By purchasing a ServSafe® product through us, you agree to comply with ServSafe®’s rules regarding:
- Personal, non-transferable use of course access
- Honest exam-taking (no cheating, sharing of exam content, or use of unauthorized aids)
- Restrictions on copying, redistributing, or reverse-engineering course or exam materials
- Time limits on course and exam access
Violations of ServSafe®’s rules may result in revocation of certifications, exam disqualification, or other penalties imposed by ServSafe®. We have no authority over or responsibility for those decisions.
7. User-Generated Content
If you submit a product review, testimonial, comment, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, display, modify, and distribute that content in connection with our business.
You represent that any content you submit:
- Is accurate and reflects your honest opinion
- Does not violate any third-party rights (including copyright, trademark, privacy, or publicity rights)
- Is not unlawful, defamatory, harassing, hateful, threatening, obscene, or otherwise objectionable
- Does not contain personal information about anyone other than yourself
We may remove any content at our discretion and without notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT:
- The Site will be uninterrupted, timely, secure, or error-free
- The information on the Site will be accurate, current, or complete
- Defects will be corrected
- The Site or its servers are free of viruses or other harmful components
- Any product purchased will meet your expectations or result in any specific outcome (such as passing a certification or obtaining employment)

10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Netiza LLC d/b/a A1 Food Safety AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, MISSED CERTIFICATION DEADLINES, OR LOSS OF EMPLOYMENT OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Netiza LLC d/b/a A1 Food Safety and its officers, directors, employees, contractors, and agents from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising from:
- Your use of the Site or any product purchased through it
- Your violation of these Terms
- Your violation of any third-party right (including intellectual property or privacy rights)
- Your content submitted to the Site
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site immediately ceases.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.
Before filing any legal action, you agree to first contact us at info@a1foodsafety.com with a written description of your concern and the resolution you are seeking. We will attempt to resolve the matter informally within 30 days.
If informal resolution fails, any legal action arising from these Terms must be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to personal jurisdiction in those courts.
Any claim must be brought within one (1) year after the cause of action arises or it is permanently waived.
14. Class Action Waiver
To the maximum extent permitted by law, you agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, collective action, or representative proceeding against us.
15. General Provisions
- Entire agreement: These Terms, together with our Terms of Sale and Privacy Policy, are the entire agreement between you and us regarding the Site.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- No waiver: Our failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our written consent. We may assign them freely.
- No third-party beneficiaries: These Terms do not create any rights for anyone other than you and us.
16. Changes to These Terms
We may update these Terms from time to time. The current version is always posted on this page with the “Last updated” date above. Material changes will be communicated by prominent notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
