These Terms of Sale (“Terms”) govern your purchase of products from a1foodsafety.com (the “Site”), operated by Netiza LLC d/b/a A1 Food Safety (“we,” “us,” or “our”). By placing an order, you agree to these Terms. Please read them carefully before completing a purchase.
If you do not agree to these Terms, please do not place an order.
1. Important Notice — Authorized Reseller and Trademark Use
A1 Food Safety is an authorized seller of ServSafe® products. We sell ServSafe® materials and exam vouchers under written trademark permission granted by the National Restaurant Association Educational Foundation. We are not the owner, developer, or manufacturer of ServSafe® products, courses, or certifications.
ServSafe® and ServSuccess® are registered trademarks of the National Restaurant Association Educational Foundation. All ServSafe® course content, exam content, certification programs, and related materials are the intellectual property of the National Restaurant Association Educational Foundation and its affiliates.
All ServSafe® products sold through this Site are sold AS-IS as authentic, sealed, original-manufacturer goods. We do not modify, repackage, or alter any ServSafe® products.
For warranty claims, technical issues, certification problems, exam access, score disputes, content questions, or any other product-related issue, you must contact ServSafe® directly:

We can assist with order-fulfillment issues (wrong item shipped, damaged-in-transit, missing items) within the timeframes set out in Section 7 below. All other product-related concerns must be directed to ServSafe®.
2. Order Acceptance
Your order is an offer to purchase. We may accept, decline, or limit any order at our discretion, including after we send an order confirmation. Reasons we may decline an order include but are not limited to:
- Product unavailability
- Suspected fraud or unauthorized payment
- Errors in pricing or product information
- Restrictions imposed by the manufacturer
- Bulk-order requests we cannot fulfill
If we cancel your order, we will refund any payment received in full.
3. Pricing, Taxes, and Payment
- All prices are in U.S. Dollars and are subject to change without notice.
- The price applied to your order is the price displayed at the time you complete checkout.
- Sales tax is applied where required by law and shown at checkout.
- Shipping and handling fees, if applicable, are calculated at checkout and added to your order total.
We accept major credit cards (Visa, MasterCard, American Express, Discover) and any other payment methods displayed at checkout. Your card is charged at the time your order is placed. If your payment fails or is later reversed, we may cancel your order and recover any product or access already provided.
We make every effort to display accurate pricing, but we reserve the right to correct pricing errors and to cancel any order resulting from such errors, even after order confirmation.
4. Product Availability and Substitutions
Product inventory is updated regularly but may not reflect real-time stock levels. If an item you ordered becomes unavailable after you place your order, we will:
- Contact you with available alternatives, or
- Refund the unavailable item in full
We do not substitute items without your approval.
5. Shipping and Delivery (Physical Products)
- We ship to addresses within the United States only, unless otherwise stated on the product page.
- Shipping times shown at checkout are estimates and not guaranteed.
- Title and risk of loss transfer to you when the carrier accepts the package from us.
- We are not responsible for delays caused by carriers, weather, customs, or events outside our control.
If your package is lost or damaged in transit, contact us within 7 days of the expected delivery date so we can file a carrier claim and arrange a replacement or refund.
6. Digital Products, Online Courses, and Exam Vouchers
Some ServSafe® products we resell consist of digital access codes, online courses, exam vouchers, or printed certificates of access. For these products:
- Access codes are delivered to the email address provided at checkout, typically within one business day of order completion.
- Once an access code has been delivered, used, or activated, the order is considered fulfilled and is not refundable.
- Course expiration, exam scheduling, score reporting, certificate issuance, and access support are managed entirely by ServSafe®. See Section 1.
7. Returns and Refunds
Physical products (sealed, unused): May be returned within 30 days of delivery for a refund of the product price (shipping fees are non-refundable). To request a return, email info@a1foodsafety.com with your order number. We will provide a Return Authorization and shipping instructions. Returns sent without a Return Authorization may be refused or delayed. Return shipping is the customer’s responsibility unless the return is due to our fulfillment error.
Items not eligible for return:
- Opened or used products
- Digital access codes that have been delivered
- Exam vouchers that have been redeemed or activated
- Custom or personalized materials
- Items returned more than 30 days after delivery
Refund timing: Approved refunds are processed within 5–10 business days to the original payment method. Banks and card processors may take additional time to post the refund.
Order errors and damage: If you received the wrong item or your shipment arrived damaged, contact us within 7 days of delivery with photos, and we will arrange a replacement or refund at no cost to you.
8. Trademarks and Intellectual Property
ServSafe®, ServSuccess®, and all related logos, course materials, exam content, certification programs, and product designs are trademarks and copyrighted property of the National Restaurant Association Educational Foundation and its affiliates.
We use the ServSafe® name and trademark under written permission from the National Restaurant Association Educational Foundation. All goodwill arising from our use of these trademarks inures to the benefit of the National Restaurant Association Educational Foundation. We claim no ownership of the ServSafe® brand or curriculum.
The a1foodsafety.com website design, original written content, photography (other than product images supplied by the manufacturer), and our business name and logo are the property of Netiza LLC d/b/a A1 Food Safety and may not be copied or reused without written permission.
9. Disclaimer of Warranties
ALL PRODUCTS ARE SOLD “AS-IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
- That any course or exam will result in passing scores, certifications, employment, or specific learning outcomes
- The accuracy, currency, or completeness of any course content (which is created by ServSafe®, not us)
- Uninterrupted access to any digital product (which is hosted by ServSafe®, not us)
Any manufacturer warranty that exists on a product is between you and the manufacturer (ServSafe®). See Section 1 for ServSafe® contact information.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR PURCHASE — WHETHER IN CONTRACT, TORT, OR OTHERWISE — IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, MISSED CERTIFICATION DEADLINES, OR LOSS OF EMPLOYMENT OPPORTUNITY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, labor disputes, supplier failures, government actions, internet outages, or carrier disruptions.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.
Before filing any legal action, you agree to first contact us at info@a1foodsafety.com with a written description of your concern and the resolution you are seeking. We will attempt to resolve the matter informally within 30 days.
If informal resolution fails, any legal action arising from these Terms must be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to personal jurisdiction in those courts.
Any claim must be brought within one (1) year after the cause of action arises or it is permanently waived.
13. Class Action Waiver
To the maximum extent permitted by law, you agree that any dispute will be resolved on an individual basis, and you waive any right to participate in a class action, collective action, or representative proceeding against us.
14. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right does not constitute a waiver of that right.
15. Changes to These Terms
We may update these Terms from time to time. The current version is always posted on this page with the “Last updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
